Acceptance of Terms
By downloading, installing, or using Octilum ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the App.
These Terms constitute a legally binding agreement between you and German Amaya ("Developer"), an individual developer based in Peru. These Terms apply to all users of the App worldwide.
Description of the App
Octilum is a personal health and wellness tracking application for iOS, providing tools to help users build and maintain healthy habits across eight categories: Running, Water, Sleep, Meditation, Breathing, Nutrition, Workout, and Bodyweight.
Eligibility
To use Octilum, you must:
- Be at least 13 years of age
- Have the legal capacity to enter into a binding agreement
- Own or have authorized access to the iOS device on which the App is installed
- Comply with all applicable local, national, and international laws
License Grant
Limited License
Subject to these Terms, Developer grants you a limited, non-exclusive, non-transferable, revocable license to download and use Octilum on Apple-branded devices that you own or control, solely for your personal, non-commercial purposes.
Restrictions
You agree not to:
- Copy, modify, or distribute the App or any portion thereof
- Reverse engineer, decompile, or disassemble the App
- Rent, lease, lend, sell, or sublicense the App
- Use the App for any commercial purpose without prior written consent
- Remove or alter any proprietary notices or labels on the App
Subscriptions and Billing
Free Trial
Octilum offers a free 14-day trial upon first launch. No payment information is required. The trial is managed in accordance with App Store policies and begins when you first open the App.
Premium Plans
Billing and Renewal
- All subscriptions are processed and managed by Apple through the App Store
- Subscriptions auto-renew unless cancelled at least 24 hours before the end of the billing period
- Manage and cancel your subscription anytime in your Apple ID account settings
Refunds
All purchases are processed by Apple. Refund requests must be submitted directly to Apple through the App Store. Developer has no control over refund decisions.
User Responsibilities
You are solely responsible for:
- The accuracy of any data you enter into the App
- Maintaining the security of your device and Face ID / passcode access
- Any decisions you make based on information displayed in the App
- Backing up your data if iCloud Sync is not enabled
- Ensuring your use complies with all applicable laws in your jurisdiction
Health and Wellness Disclaimer
The content, programs, and tracking tools provided in Octilum are designed for general wellness and habit-building purposes only.
Developer expressly disclaims any liability for health outcomes resulting from use of the App. You assume all risk associated with your participation in any physical activity, nutrition program, or wellness practice tracked or guided by Octilum.
Intellectual Property
All content within Octilum — including app design, graphics, UI elements, audio tracks, text, logos, and software code — is the exclusive property of German Amaya or its licensors, protected by applicable intellectual property laws.
The audio tracks available in the Sleep and Meditation categories are licensed for use within Octilum only and may not be downloaded, recorded, or redistributed in any form.
The "Octilum" name and logo are proprietary to German Amaya. Nothing in these Terms grants you any right to use Octilum's trademarks or brand features.
Apple HealthKit
Octilum integrates with Apple HealthKit. You acknowledge that:
- HealthKit data is accessed only with your explicit permission
- Octilum reads HealthKit data solely to import it into your local activity logs
- HealthKit data is never shared with third parties or stored on external servers
- You may revoke HealthKit access at any time via iOS Settings
Third-Party Services
Octilum uses the following third-party services:
- Apple App Store — app distribution and payment processing
- Apple iCloud / CloudKit — optional data synchronization
- Apple HealthKit — optional health data import
- Google Firebase — audio content delivery and app content management
Developer is not responsible for the practices or content of any third-party services.
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GERMAN AMAYA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. IN NO EVENT WILL DEVELOPER'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you. In such cases, liability is limited to the maximum extent permitted by applicable law.
Termination
Developer reserves the right to terminate or suspend your access to the App at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the App will immediately cease.
Governing Law
These Terms shall be governed by the laws of Peru. For users in the United States, applicable U.S. consumer protection laws may also apply. Disputes shall be submitted to the competent courts of Lima, Peru.
Changes to These Terms
Developer reserves the right to modify these Terms at any time. When changes are made, the "Last Updated" date will be revised. Continued use of the App after such changes constitutes your acceptance of the revised Terms.
Apple End User License Agreement
The following terms apply with respect to Octilum's distribution through the Apple App Store:
- These Terms are between you and German Amaya — not Apple, Inc.
- Apple has no obligation to furnish maintenance or support services for the App
- Apple is not responsible for addressing any claims relating to the App
- Apple is a third-party beneficiary of these Terms and may enforce them against you
- In the event of conflict between these Terms and Apple Media Services Terms, Apple's terms prevail
